Alpine is considering whether it can take further action following the decision of the FIA International Court of Appeal regarding the result of the Monaco Grand Prix in Formula 1. The team is analyzing its options after Flavio Briatore questioned the independence of one of the judges involved in the ruling.

This Court decision announced on Friday (04) reinstated the two five-second penalties imposed on Pierre Gasly for speeding in the pit lane. As a result, the Frenchman dropped back to seventh place and Isack Hadjar officially regained third place, securing his first podium for Red Bull Racing and the second in his career.
Speaking of Monza, Briatore pointed to Filippo Marchino, one of the four members of the panel responsible for the case, and claimed that the judge had ties to McLaren, one of the teams that filed an appeal against the Monaco result, along with Red Bull Racing, casting doubt on his independence. McLaren responded to the statements, with team principal Andrea Stella calling the Alpine advisor’s comments ‘insulting’.
Although Alpine had previously stated it would accept the Court’s decision, even while clearly disagreeing with the outcome, the team is now examining possible alternatives. One of these is provided for in the FIA regulations themselves, which allow for a review request when new and relevant evidence emerges, unknown at the start of the process, capable of casting doubt on or prompting a change to the decision.

The request can be submitted by one of the parties involved, and since the case affects the championship standings, the deadline set by the rules ends on November 30 of this year. It will be up to the International Court of Appeal itself to assess whether there are sufficient grounds to reopen the process.
Briatore maintains that Alpine only became aware, after the hearing, of the information that supported his questions about Marchino. However, this does not automatically mean that the requirements for a review have been met, since the judges must be identified before the start of the process and any objections to the panel’s composition can be raised at that time, which did not happen in this case.
The FIA rules also leave open the possibility of action before another court or tribunal after internal appeals within the entity have been exhausted. Article 17, however, stipulates that the procedures provided within the FIA must be completed first, and also requires that the federation be notified if external action is initiated.
